StarHub takes the issue of your privacy seriously. Generally, you can visit StarHub's websites without telling us who you are or revealing any information about yourself. However, there are services offered on StarHub's websites you may subscribe to by providing to us your personal information as requested. Personal Information refers to all and any information relating to you obtained by us in the course of and as a result of provision of the services by us. Governing Law

By assessing StarHub's websites and online services, you agree that such access and/or use, as well as these Terms shall be governed by, and construed in accordance with Singapore laws and you agree to submit to the exclusive jurisdiction of the Singapore courts.

General Terms

No failure or delay by StarHub to exercise or enforce any of its rights under these Terms will operate as a waiver of such rights nor will such failure or delay in way prejudice or affect its right at any time thereafter to act strictly in accordance with our rights under the Terms.

The use of StarHub's services is also subject to StarHub's Terms & Conditions (found at www.starhub.com) and such other terms and conditions as may be agreed or accepted by you (collectively, “StarHub Terms and Conditions”). If there is any conflict or inconsistency between any of StarHub Terms & Conditions and any of these Terms, such conflict or inconsistency will be resolved in a manner most favourable to StarHub and its affiliates. However, if such conflict or inconsistency cannot be so resolved, StarHub's Terms & Conditions will prevail over these Terms.

As a provider of Internet access, web-hosting, and other Internet-related services ("Services"), StarHub Ltd ("StarHub") offers its customers and service users (collectively known as "Customers"), the means to acquire and disseminate a wealth of public, private, commercial, and non-commercial information.

This AUP is intended to protect you and the Internet community at large from inappropriate use of the Internet. StarHub reserves the right to take certain preventative or corrective actions to prevent such inappropriate use, including but not limited to the suspension or termination of any Services provided to you if your use of the Service(s) violates this AUP. This AUP forms part of your agreement with StarHub. Your use of the Service(s) constitutes acceptance of this AUP.

1. You are responsible for the use of the Services under your account(s) and any activity carried out under your account, whether such activities were carried out with your consent and/or knowledge or otherwise.
   
2. StarHub does not, and does not assume any responsibility to review, edit, monitor, verify, warrant, or vouch for the accuracy and quality of the information and Content that you may acquire and/or publish through the Services or on the Internet and is not responsible for such information, Content, posting or activity. StarHub does not accept any responsibility for injury or damage to you arising out of or in relation to inaccurate, unsuitable, offensive, or illegal Internet communications.
   
   
3. StarHub shall not be responsible for the security of information transmitted over StarHub's facilities. You are responsible for ensuring the security of your network and/or your computer(s). You must immediately notify StarHub of any unauthorized use of an account, and/or breach or attempted breach of security known to you.
   
   
4. You are required to :-

4.1 provide accurate and complete information to us and inform us immediately of any changes in any particulars or information given to us in the application for the Services, including but not limited to any changes in your address and/or contact particulars.

4.2comply with all applicable laws, rules and regulations and any requirements or restrictions which we or other Service Providers may impose on the use of the Services, or any telecommunications system and Equipment.

4.3 comply with all instructions, notices or directions issued by us; and

4.4 take all reasonable steps to prevent fraudulent, improper and illegal use of the Services.

5. You must not use or allow any part of the Services to be used:-

5.1 to send or facilitate the sending of, unsolicited bulk and/or commercial messages over the Internet to any person or system ("Spamming" or "Spam Emails"), which includes any e-mails sent in a manner that could adversely affect and/or overload the Network and disrupt service to the Customers, including the maintenance of an open SMTP relay. Spam Emails do not have to be sent from your account or StarHub's network to violate this AUP. Email sent by or through a third party that advertises or otherwise directs traffic or links to your web site or your account shall be deemed as being sent directly by you. StarHub requires that you maintain a "Confirmed Opt-In" mailing list, and may require you to provide verifiable confirmation information in cases where Spamming is alleged;

5.2 in any manner or for any purpose which may violate the intellectual property rights and confidentiality rights of a third party, including but not limited to copyrights, trademarks, service marks, trade secrets, software piracy, and patents; or violates privacy, publicity, or other personal rights of others;

5.3 to transmit or post any Content that may give rise to civil liability or otherwise violates any law or regulation (including without limitation, the laws and regulations governing criminal activity, export control, unfair competition, anti-discrimination or false advertising);

5.4 to transmit or post any content which may be defamatory, offensive, indecent, objectionable or illegal, and which may cause annoyance, harassment, irritation, inconvenience or anxiety to anyone. This includes transmitting or posting of "junk mail", "spam", "chain letters", "solicitations" (commercial or non-commercial) or distributing mail to any party which has not given permission to be included in the distribution;

5.5 to advertise, transmit, store, post, display, or otherwise make available child pornography;

5.6 to forge or misrepresent message headers, whether in whole or in part, to mask the originator of the message or employing any other method to disguise or mislead any user name or the source or quantity of the emails transmitted;

5.7 to make or attempt any illegal or unauthorized access to the Services, StarHub's network, or to any computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "Hacking") to which you connect through the Services directly or otherwise; or to carry out or attempt any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity);

5.8 to distribute information regarding the creation of and/or the distribution or transmission of material or Content containing Internet viruses, worms, Trojan horses, time bombs, cancelbots, and/or any other harmful, damaging or destructive programs; or to carry out or attempt to carry out activities that disrupt the use of or interfere with the ability of others to effectively use the Network or any connected network, system, service, or equipment, including but not limited to pinging, flooding, mailbombing and denial of service attacks;

5.9 to disrupt the various networks connected to the Services or violate the regulations, policies or procedures of such networks;

5.10 to collect and/or disseminate information about others or their email addresses without their consent;

5.11 to advertise, transmit, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks, and piracy of software. This can include failure to update software used on your account or web site that is known to be vulnerable to malicious activity or exploitation. You shall also use secure passwords to protect your account and associated email accounts. Use of passwords deemed by StarHub, in its sole discretion, to be insecure shall be a violation of this AUP;

5.12 to engage in activities that are determined to be illegal, including advertising, transmitting, or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards, and pirating software;

5.13 to conduct any port, security, or penetration scans on StarHub's or its Service Providers' servers or network; and

5.14 to engage in activities, whether lawful or unlawful, that StarHub determines, in its sole discretion, to be harmful to its Customers, operations, reputation, goodwill, or customer relations.

6. You further acknowledge and agree that StarHub reserves the right not to accept postings from newsgroups where it comes to StarHub's attention that the content of the newsgroup violates the AUP.
   
   
7. In the event that you breach or are alleged to have breached any provision of this AUP, StarHub may, in its sole discretion, with or without notice to you, remove, disable or refuse to post Content or materials that violate this AUP; or to suspend or terminate the Services provided to you.
   
   
8. StarHub may, in its sole discretion, remove or disable the materials and Content of any Customer, or suspend or terminate the Customer's service(s) if the Customer's materials, posting or links allegedly infringe trademarks, copyright or any other intellectual property rights of third parties. StarHub shall not be responsible for determining the validity of the allegations of infringement.
   
   
9. StarHub will not intentionally monitor private electronic mail messages sent or received by its Customers unless required to do so by law, governmental authority. StarHub may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. StarHub will not intentionally disclose your online communications or activities, including but not limited to, your account information, a transmission made using our network, or a web site, except to comply with a court order, subpoena, statute, regulation, or governmental requests; or where necessary to protect StarHub and others from harm, or where such disclosure is necessary to the proper operation of the system.
   
   
10. StarHub will determine in its sole discretion, on a case-by-case basis, what action will be taken in response to a violation of this AUP. StarHub reserves the right to investigate suspected or alleged violations of this AUP, including but not limited to obtaining information from the Customers, complainant and the examination of the materials on StarHub's server. Nothing contained in this AUP shall be construed to limit StarHub's actions or remedies in any matter. StarHub reserves the right to take any and all additional actions as it may deem appropriate in relation to such activities. StarHub reserves at all times all rights and remedies available to it in respect of such activities at law.
    
    
11. You agree to indemnify StarHub and all of StarHub Service Providers in full for any violation of this policy that results in loss to StarHub or the bringing of any claim against StarHub by any third-party.
    
    
12. StarHub and StarHub's Service Providers shall not be liable for any damages of any nature suffered by any Customer or third party resulting in whole or in part from StarHub's exercise of its right under this Policy. By using the Services, you agree to waive and hold StarHub and StarHub's Service Providers harmless from any claims relating to any action taken by us, including the conduct of an investigation, issuance of a warning, refusal to post material, removing material, or suspending or terminating the Services, or other appropriate action in relation to all violations described in this AUP.
    
    
13. Any complaints about a Customer's violation of this AUP should be sent to the StarHub Abuse Response Team at abuse@starhub.com.
    
    
14. StarHub reserves the right to amend, alter and modify this AUP at any time, in its sole discretion without prior notice. Your continued use of the Services will constitute your acceptance of this AUP (including revisions thereof).
    
    
15. This AUP shall be governed and construed by the laws of Singapore and you irrevocably submit to the jurisdiction of the Singapore courts.
