StarHub TV Anywhere
In this Section :-
2.1 Unless otherwise permitted by us in writing, the StarHub TV on Cable and StarHub TV on IPTV Services are only available to residential customers for residential use.
2.2 At the time of application, you must not have any outstanding accounts with us that are due and owing to us.
2.3 Unless otherwise permitted by us in writing, the StarHub TV on Cable Service is only available at residential Premises. Subject to Clauses 2.6 and 2.7 below, the StarHub TV on Cable Services may be delivered via either of the following modes :-
(a) our nation-wide hybrid fibre co-axial network, provided that the Premises must first be connected to our nation-wide hybrid fibre co-axial network. Without prejudice to the foregoing, our Smart TV and HD Service are only available at such Premises;
(b) our DTTV (only for Premises falling within the categories set out in Clause 2.7 below). Our Smart TV and HD Service are not available via DTTV.
2.4 Unless otherwise permitted by us in writing, the StarHub TV on IPTV Service is only available at residential Premises. The StarHub TV on IPTV Service may be delivered via our IPTV network.
2.5 You acknowledge and agree that availability of the StarHub TV on Cable StarHub TV on IPTV Services are subject to :-
(a) availability of resources, including but not limited to, availability of a suitable network infrastructure at the time at which the Service is requested or delivered;
(b) geographical coverage and technical capacity of our Network and of our delivery systems at the time at which the Service is requested or delivered.
2.6 Without prejudice to such other requirements which may be imposed by us from time to time, the StarHub TV on Cable Service to be delivered via DTTV will only be available to such property or property unit as may be determined by us in our absolute discretion.
2.7 Where the StarHub TV on Cable Service is delivered via DTTV :-
(a) you must procure, install and maintain all facilities and equipment (including but not limited to the antennae, wiring and cable points) which are necessary or desirable for the reception of the programming signals;
(b) you must procure and maintain all consents, licences, permits and/or rights which are necessary or desirable for the installation and maintenance of such facilities and equipment, and the reception of the programming signals;
(c) you must liaise with and procure the relevant management corporation or building/apartment block owner to procure, install and/or maintain the facilities, equipment consents, licences, permits and/or rights referred to in paragraphs (a) and (b) above; and
(d) we will not be responsible for the quality of the programming signals received through such facilities and equipment. We will only be responsible for the quality of the programming signals transmitted up to the point of pick-up or reception of such signals by the antenna located at the Premises. Without prejudice to the foregoing, we will not be responsible for any Service failure, interruption or performance degradation arising from any failure to procure, install and/or maintain such facilities and equipment, and/or such facilities and equipment themselves.
3. Eligibility for StarHub TV.com Service
3.1 Unless otherwise permitted by us in writing, the StarHubTV.com Service is only available to you if you :-
(a) are resident in the Territory;
(b) have a valid Hub ID;
(c) have internet connection with a download speed of at least 2Mbps whether or not provided by us;
(d) have a compatible device that can access the internet at a minimum download speed of at least 2Mbps;
(e) have a web browser; and
(f) download the relevant Software where necessary.
3.2 The StarHubTV.com Service will be made available and can only be accessed and viewed by you via :-
(a) your Hub ID; and
(b) one device at any time and not simultaneously through multiple devices.
3.3 The StarHubTV.com Service will be delivered to you via the internet and you acknowledge and agree that availability of the StarHubTV.com Service is subject to :-
(a) internet connectivity;
(b) the type of devices that you use to access the StarHubTV.com Service and the Software installed in such devices.
3.4 We will not be responsible for the internet connectivity or devices through which you access the StarHubTV.com Service, which may affect the quality of the StarHubTV.com Service. Without prejudice to the foregoing, we will not be responsible for any StarHubTV.com Service failure, interruption or performance degradation arising from any failure in internet connectivity and/or the devices through which you access the StarHubTV.com Service or any lack of compatibility thereof.
4. Eligibility for TV Anywhere Services
4.1 Unless otherwise permitted by us in writing, the TV Anywhere Service is only available to StarHub TV on Cable customers who :-
(a) subscribe to and maintain a minimum of 3 Basic Groups under the StarHub TV on Cable Service, or such other minimum subscription as may be notified by us from time to time;
(b) do not have any outstanding accounts with us that are due and owing to us at the time of application; and
(c) have a valid Hub ID.
4.2 The TV Anywhere Service will be delivered to you via the internet or such networks and platforms as may be notified by us, which we may not own, lease/licence or operate. You acknowledge and agree that the availability of the TV Anywhere Service is subject to :-
(a) internet connectivity, the quality and connectivity of such networks and platforms on which the TV Anywhere Service will be made available;
(b) the type of devices that you use to access the TV Anywhere Service and the Software installed in such devices.
4.3 We will not be responsible for the internet connectivity, such as the quality and connectivity of such networks or platforms, or devices through which you access the TV Anywhere Service, which may affect the quality of the TV Anywhere Service. Without prejudice to the foregoing, we will not be responsible for any TV Anywhere Service failure, interruption or performance degradation arising from any failure in internet connectivity, networks, platforms and/or the devices through which you access the TV Anywhere Service or any lack of compatibility thereof.
4.4 The TV Anywhere Service will be made available and can only be accessed and viewed by you via :-
4.5 You must at all times provide us with such information as may be necessary or desirable for us to provide you with the TV Anywhere Service.
4.6 We may decline acceptance of your application at our discretion.
5. Other Eligibility Criteria
You must at all times provide us with such information as may be necessary or desirable for us to provide you with the relevant Service.
6. Minimum Period of Service
The Minimum Period of Service for our post-paid StarHub TV on Cable Service is :-
(a) (if you are an individual) 3 months; or
(b) (if you are a corporation or business entity) 6 months,
from the commencement date as determined in accordance with Clause 7 below, or such other periods as we may determine from time to time.
7. Duration of Services
Each Service under this Agreement will commence on the following dates :-
(a) the date of successful on-site installation of the Equipment by us, if you request us to install the Equipment;
(b) the date of sign up for the Service and collection of the Equipment, if you self-install the Equipment;
(c) such other date as may be stated in the application form or work order or otherwise approved by us in writing;
(d) in relation to the StarHubTV.com Service, the first date of access of the StarHub TV.com Service via your Hub ID; or
(e) in relation to the TV Anywhere Service, the first date of access of the TV Anywhere Service on any available platform.
This Agreement will continue until terminated according to the provisions of this Agreement.
8.1 Under this Agreement, we will provide to you :-
(a) the StarHub TV on Cable Service at the Service Address in accordance with the particulars set out in the relevant service agreement or work order;
(b) the StarHubTV.com Service at www.starhubtv.com, in the Territory only and via your Hub ID; and
(c) the TV Anywhere Service to be made available to you at www.starhubtv.com and/or such other platforms via which the TV Anywhere Service may be made available as we may notify from time to time.
8.3 You may request for us to change, from time to time, the Service particulars set out in the relevant service agreement or work order, subject to our confirmation and payment of any standard administrative fee chargeable by us. In the event of such change, the subscription fees payable for our post-paid Service and the Service particulars will be amended accordingly. For the avoidance of doubt, you will continue to be liable for the payment of such revised subscription fees.
8.4 If you wish to upgrade or downgrade your existing channels (“Existing Channels”), we may, at our discretion, agree to or decline your request. If we agree to your request for upgrading with immediate effect, the prevailing additional Charges will apply concurrently. We may allow your request to downgrade when you have subscribed for the Existing Channels for at least one continuous month. The effective date of downgrading will occur at the start of the next billing cycle after we receive your notice to downgrade as long as you have a continuous subscription of one month immediately preceding the downgrade. We may charge you an administrative charge each time you make a change to your channel combination.
8.5 You must exhibit the channels or programmes received as part of the Services in their entirety without any interruptions including all titles, credits, logos and copyright notices. You will not, for any purpose whatsoever, alter, reproduce, edit, supplement, omit or circumvent any channel or programme received as part of the Services, including the insertion of crawlers or advertisements either immediately before, during or after the exhibition or broadcast of the channel or programme.
8.6 We may, at any time and without any notice to you, temporarily suspend the Services for operational reasons such as repair, maintenance, upgrade or improvement of the Services or because of an emergency. We will restore the Service as soon as reasonably practicable. We may also modify the Services in order to keep pace with the prevailing demands and technological developments, at our discretion and without any notice to you.
8.7 The use of the Services is subject to any instructions, notices and directions as may be determined by us from time to time.
9. Additional StarHubTV.com services : Live TV, Video-On-Demand and Catch-Up TV
9.1 As part of the StarHubTV.com Service, we may offer such additional services as may be notified by us from time to time, including Live TV, VOD and Catch-up TV services.
9.2 StarHub retains the sole right and discretion to determine the Content that would be available for each of the LiveTV, VOD and Catch-Up TV services.
9.3 In relation to the Live TV service, you will be granted access only to such Content that you (i) subscribe for specifically under the StarHubTV.com Service; and (ii) have already subscribed to under your StarHub TV on Cable subscription if you have procured the TV Anywhere Service.
9.4 In relation to the VOD service available under the StarHubTV.com Service :-
(a) Charges will apply for each Video rented by you, and the Charges are inclusive of GST;
(b) there will no cancellation, refund or exchange for rental of selected Videos;
(c) the Videos will be available to you for viewing on the StarHubTV.com Service only during the prescribed Viewing Period, subject always to the Content Expiry Date. The Videos will not be available to you whether for viewing or in any other form, after the Content Expiry Date;
(d) the Viewing Period on the StarHubTV.com Service will be 48 hours for movies and single episodes of TV services and 30 days for entire series, or such periods as may be prescribed by us from time to time; and
(e) we reserve the right to reject any request by you to rent or purchase any Video.
9.5 You acknowledge and accept that the aforesaid rental of a Video via the StarHubTV.com Service is a limited license and not a sale with respect to such Video. Save and except for a non-exclusive, non-transferable, limited license to view each rented Video for the stipulated Viewing Period on StarHubTV.com Service solely for your personal, non-commercial viewing, no right, title or interest in such Video shall be deemed transferred to you as a result of the rental.
9.6 The VOD service provided to you through the StarHubTV.com Service shall be subject to such other usage, rental or licence conditions as we may notify you from time to time.
9.7 In relation to the Catch-Up TV provided to you through the StarHubTV.com Service, the relevant Content will be available for viewing only during the specific timeframe as may be prescribed by us from time to time.
10. Content and Your Responsibilities
10.1 We retain the sole right and discretion to determine the type, nature, genre, quality and quantity of Content made available on or through any of the Services.
10.2 You are responsible for the use of the Services under your account(s) and for any Content disseminated through your account(s).
10.3 You must not use or allow any part of the Services to be used :-
(a) to transmit or post any Content which may be defamatory, offensive, indecent, objectionable or illegal, or which may cause annoyance, harassment, irritation, inconvenience or anxiety to anyone. This includes transmitting or posting "junk mail", "spam", "chain letters", "solicitations" (commercial or non-commercial) or distributing mail to any party who has not given permission to be included in the distribution;
(b) to transmit or post any Content which may give rise to civil liability or otherwise violate any applicable laws, rules or regulations;
(c) to transmit any Content that contains viruses, worms, trojan horses, time bombs, cancel bots or any other harmful, damaging or destructive programs;
(d) to make or attempt any unauthorised access to any part or component of the Services, the Network or any third party systems or networks to which you can connect through the Services directly or otherwise;
(e) to disrupt the various networks that are connected to the Services or violate the regulations, policies or procedures of such networks;
(f) to collect and/or disseminate information about others or their email addresses without their consent;
(g) for any fraudulent, illegal or improper purposes or to violate anybody's rights or in any way which may affect other users' enjoyment of or access to any of the Services or cause annoyance, harassment, irritation, inconvenience or anxiety to anyone;
(h) in any manner or for any purpose which may constitute a violation or infringement of the rights of any party including but not limited to their intellectual property or confidentiality rights;
(i) to be resold or otherwise provided to third parties without our prior written consent, whether for profit or not;
(j) to transmit any Content received under the Services to any personal computer, laptop, mobile phone or other similar device(s) unless otherwise permitted by us; and
(k) to transmit any Content received under the Services outside the geographic boundaries of Singapore unless otherwise permitted by us.
10.4 You acknowledge and agree that through your use of the Services, you may encounter Content which may be deemed offensive, indecent, or objectionable, which Content may or may not be identified as such. You agree to use the Services at your sole risk and that we will not have any liability to you for the type of Content that you may access, including without limitation Content that you may find offensive, indecent, or objectionable.
10.5 You acknowledge and agree that the Content accessed through the Services may be altered with technology and/or rules which protect digital information from access and may limit or restrict your usage of Content to certain usage rules as may be determined by us and our licensors (the "Usage Rules"). You agree to comply with the Usage Rules. The Usage Rules may be controlled and monitored by us for compliance purposes, and we reserves the right to enforce the Usage Rules with or without notice to you.
10.6 The StarHub TV on Cable Service is a streaming Service and you are not permitted to download any of the Content at any time for any reason.
11.1 For our post-paid Services, you will be billed in advance for the subscription fees at monthly intervals or such intervals as may be approved by us, unless you elect to prepay the subscription fees. You will be subject to a standard late payment fee if payment is not made by the relevant due date.
11.2 For our post-paid Services, any change in the method of payment will only be effected from the next billing cycle onwards.
12.1 In order to access the Services, you must acquire such Equipment as may be determined by us. You may acquire the Equipment in the following manner :-
(a) Post-paid StarHub TV on Cable Service
If you wish to subscribe to our post-paid StarHub TV on Cable Service (including our DTTV Service), you must rent the set-top box from us. You must pay us our prescribed Charge(s) for the rental.
(b) Smart TV Service
If you wish to sign up for our Smart TV Service, you must rent the HubStation or HubStation HD from us. You must pay us our prescribed Charge(s) for the rental.
(c) HD Service
If you wish to sign up for our HD Service, you must rent the HubStation HD, HD Interactive set-top box or HD set-top box from us. You must pay us our prescribed Charge(s) for the rental.
12.2 If you rent the Equipment from us, the Equipment will remain at all times our property. You must not allow any person to modify such Equipment without our prior written consent.
12.3 You must keep the Equipment in a suitable place and appropriate conditions for the Equipment, including any necessary electrical power supply. You must also use and maintain the Equipment in good working condition(fair wear and tear excepted) in accordance with the guidelines, instructions or specifications given to you.
12.4 You must ensure that the Equipment shall at all times remain in your custody at the Service Address and be used only to receive the Services.
12.5 You are solely responsible for the Equipment and must not modify, tamper or in any way interfere with, nor allow anyone else (other than a person authorised by us) to do so. You will not change the serial number or equipment identifier of the Equipment or to perform a factory reset of the Equipment without our prior written consent. We reserve the right to suspend or terminate your Service(s) if we determine, in our absolute discretion, that you have tampered with the Equipment.
12.6 We reserve the right to charge you at our standard rates for responding to a service call or request to change or replace any defective Equipment, unless we subsequently ascertain that the malfunction or defect is not caused by or attributable to your act, omission, equipment or systems.
12.7 You must comply with all applicable laws and instructions, notices or directions issued by the relevant regulatory authority or us from time to time in respect of the installation, use, operation or upgrade of the Equipment.
12.8 Upon our notification, you will grant us access to the Equipment and the Software embedded therein as and when we deem necessary to carry out any equipment upgrade.
13. System Requirement
You are responsible for ensuring your equipment, computers, devices and systems connected to the Network meet the Services’ minimum system requirements as may be stipulated by us, and that they are compatible and may properly function and inter-operate with the Equipment, the Services and the Network. We will not be liable for any Equipment, Service or Network failure or performance degradation resulting from the non-compliance of such requirements as set by us from time to time. You acknowledge and accept that certain applications are not supported by the Services.
14.1 In the case where you request for installation of the Equipment or where collection of the Equipment is required, you will provide us, our employees and contractors safe access to your Premises for such installation and collection.
14.2 You represent and warrant that you are the lawful owner or authorised user of such equipment, computers and devices, and that you have obtained all necessary permissions to allow us, our employees and contractors to provide Software for such equipment, computers and devices.
14.3 Any Service failure due to subsequent changes to the system configuration after successful installation is your sole responsibility. Any Charges as a result of rectifying such fault caused by you or any third parties will be borne by you.
14.4 Standard charges will be chargeable for installation of the Equipment and any cable-points at your Premises and also for collection of the Equipment.
15.1 The Services are provided on an "as is" and "as available" basis and you agree and accept that you use the Services or rely on any Content obtained through the Services at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you from us or through the Services will create any warranty not expressly made in this Agreement.
15.2 If you are dissatisfied with any of the Services or with the Content, products or services available on or through any of the Services or with any of the terms and conditions of this Agreement, your sole and exclusive remedy is to discontinue accessing and using the Service or terminate the Service according to this Agreement.
16. Proprietary Rights
16.1 All Content contained in sponsor advertisements or presented to you through the Services by us, our advertisers, content/applications providers or third parties, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You agree that you are only permitted to use such Content as expressly authorised by us, the advertiser, the provider or third party in question.
16.2 You are not permitted to copy, reproduce, distribute, or create derivative works from such Content without written authorisation from us, the advertiser, the provider or third party in question.
16.3 You acknowledge and agree that save and except for the limited permissions on the use of the Services and Content as expressly provided in these Terms and Conditions, no right, title or interest in any of the Content shall be deemed transferred to you through the provision of the Services or through access to the Content that you obtain through the Services.
You will not resell or otherwise provide any of the Services to third parties without our prior written consent, whether or not for profit or otherwise.
18. Matters Beyond Our Control
18.1 We will not be liable for any delay or failure in performance under this Agreement resulting from matters beyond our control. These include acts of God, requirements of any governmental or regulatory authority, war, national emergency, accident, fire, lightning, equipment failure, computer software or Software malfunction, electrical power failure, faults, interruption or disruption of the Network or the networks of other Service Providers or of your equipment or the equipment of any third party, riots, strikes, lock-outs, industrial disputes (whether or not involving our employees) or epidemics of infectious diseases.
18.2 Without prejudice to the paragraph above, the Services may occasionally be affected by interference caused by objects beyond our control such as buildings, underpasses and weather conditions. When this happens, we will not be responsible for any interruption or disruption of any of the Services or if you cannot access or use any of the Services.
19. Ending the Services
19.1 Without prejudice to the rights either party may have against the other party under this Agreement for any antecedent breach of this Agreement and subject to the provisions of this Clause 19, each or all of the Services under this Agreement or this Agreement may be terminated in the following manner unless otherwise agreed in writing by you and us :-
(a) by you giving us prior notice of at least 7 working days before the next billing cycle if you are an individual, or 1 month if you are a corporation or business entity; or
(b) by us giving you prior notice of 7 working days if you are an individual, or 1 month if you are a corporation or business entity.
19.2 If you give us notice that ends during the Minimum Period of Service pursuant to Clause 19.1 above :-
(a) an early termination Charge will be imposed on you;
(b) Clause 19.7 below will apply.
19.3 If any Service or this Agreement is terminated pursuant to Clauses 19.4 and 19.5 below, you will compensate us for any damages or losses we may suffer because of the early termination, including the sums referred to in Clause 19.2 above.
19.4 In the event of any of the following :-
(a) you breach any of the terms and conditions of this Agreement or any other agreement you have with us;
(c) you become or threaten to become bankrupt or insolvent, or die;
(d) you make any arrangement or composition with or assignment for the benefit of your creditors or go into either voluntary or compulsory liquidation or a receiver, trustee, judicial manager or administrator is appointed over any of your assets;
(e) the equivalent of any of the events referred to in paragraphs (c) and (d) above under the laws of any relevant jurisdiction occurs to you;
(f) you provide incorrect, false or incomplete information to us;
(g) the requirements of any relevant regulatory authority result in us having to stop providing the Service or the Network connection, or to provide the Service or the Network connection in a manner which is unacceptable to us;
(h) if you are likely to create imminent harm (such as interruption, disruption, congestion, signal leakage and any Unauthorised Act) to our Network or any third party's networks or systems or our provision of Service, or defraud us, or are likely to create imminent harm or are abusive to our personnel;
(i) if the Premises or the building within which the Premises is located is or has been disconnected from the Network for any reason whatsoever; or
(j) for any reason beyond our control (including loss of any licence, way-leave or easement, requirements of any governmental or regulatory authority or orders by the court and failure to deliver by a third party supplier) we are unable to provide any of the Services or the Network connection,
we may suspend or terminate all, any or part of any of the Services or terminate this Agreement with 7 working days' notice (for paragraphs (a), (f) and (i) above) or with immediate effect (for paragraphs (b), (c), (d), (e), (g), (h) and (j) above) without compensation and without prejudice to our rights to damages for any antecedent breach by you of this Agreement. You may immediately contact our customer service, either by calling our customer service line or visiting any of our customer service centres to tell us why such suspension or termination should not occur. We will consider each case and where we deem appropriate, will not proceed with the suspension or termination of such account or take any other appropriate action where necessary.
19.5 In the event that we suspect that you are using or allowing any of the Services to be used for fraud, misconduct or any other illegal or improper purpose, we will refer this to the relevant authorities without notice to you and comply with directions or guidelines issued by them without further reference to you.
19.6 If and when you make good any breach or default, we may restore any suspended or terminated Service after you have paid for any restoration or re-connection Charges and reimbursed us for our reasonable costs in suspending or terminating the Service.
19.7 If a Service is terminated :-
(a) all sums due, accruing due or payable to us in respect of the Service, the Equipment up to the date of termination (including late payment charges) will, upon the termination, become immediately due and payable to us;
(b) you must immediately return to us all Equipment which we have provided to you in respect of that Service in good condition. We will be entitled to charge you all costs incurred in repossessing or acquiring replacement for any such Equipment which you have failed to return to us, or at our standard prescribed rates for acquiring a replacement for any Equipment which is returned to us in a damaged or defective condition;
(c) the deposit will be refunded to you according to Clause 3 of the Consumer General Terms and Conditions.
19.8 Without prejudice to and in addition to the foregoing, in the event that for any reason your :-
(a) StarHub TV on Cable Service is terminated, your TV Anywhere Service will be simultaneously and automatically terminated without further notice or liability to you by us;
(b) TV Anywhere Service is terminated, your access to the Content that you had subscribed to under your StarHub TV on Cable subscription will cease to be available on any of the TV Anywhere networks and platforms.
20.1 We may change any of the Services by amending, substituting or withdrawing any channel, programme or channels’ grouping/package in such manner as we may determine in our absolute discretion. We may also from time to time revise the Charges for the Service.
20.2 For promotional offers of the Service, special terms and conditions may apply.
