Fibre Broadband Services
1.1 In this Section:-
1.1.1 "Charges" refers to all activation/connection, disconnection, reconnection, usage, subscription, installation, service call and administrative charges and other fees and charges to be paid by you for or relating to the Service. The Charges will be in accordance with the rates in our prevailing rate tables available on our website or at our customer service centre;
1.1.2 "Service" refers to StarHub SafeShield Service and any related enhanced/value-added services provided by StarHub Ltd (Reg. No. 199802208C);
1.1.3 "Service Address" refers to a residential address in Singapore at which we agree to provide the Service; and
1.1.4 "Software" refers to any software program and firmware, including any upgrades provided to you as part of the Service or which allows you to access the Service.
2.1 The Service is applicable to residential customers for residential use in Singapore only.
2.2 In order to subscribe to the Service, you must be at least 18 years old and provide us a functioning email address. You shall be responsible for providing us with a valid and accurate email address for the provision of the Service.
2.3 You must at all times provide us with such information as may be necessary or desirable for us to provide you with the Service.
3.1 The Service under this Agreement will commence on the date that we send to you the service activation email (“Commencement Date”), regardless of whether you have activated the software product key.
3.2 You agree to pay for such charges (including monthly recurring charges) as may be applicable for the provision of the Service from the Commencement Date.
3.3 This Agreement will continue until terminated in accordance with the provisions of this Agreement.
4.1 We will provide the Service to you in accordance with the particulars set out in the application form or work order, unless this Agreement is terminated in accordance with the provisions of this Agreement.
4.2 Each Subscription will comprise of up to 3 user licences. If you require for more than 3 user licenses, you will have take on an additional subscription of the Service. Notwithstanding the aforesaid, you agree that each Service Address is entitled to a maximum of two (2) subscriptions of the Service.
4.3 You will not be charged for the re-installation of the Software for the Service if you do not exceed the number of licenses allocated to you.
4.4 You acknowledge and agree that the Service may be accompanied by an end user licence agreement from us or a third party. You must not install or use any Softwre that is accompanied by an End User Licence Agreement unless you first agree to the terms of that End User Licence Agreement.
4.5 This Service does not include the provision of any telecommunications service (including internet connection) which may be required for the installation of the Software and use of the Service. You are solely responsible for providing all telecommunications services (including internet connection) that may be necessary for the installation of the Software and use of the Service.
5.1 You acknowledge and agree that your use of the Service is at your sole responsibility, is solely at your own risk and is subject to all applicable laws and regulations. We reserve the right to immediately suspend or terminate your service, if we determine in our absolute discretion, that you use the Service in violation of any applicable law or regulation.
5.2 We make no warranty or representation that the service will be compatible with your equipment or networks. You are solely responsible for ensuring the compatibility of the Service with any equipment or network and we will not be responsible for any failure, disruption or interference in the Service or such equipment, which may arise from your use of the Service in conjunction with your equipment.
5.3 You are advised to back up all files and data in your computer before the installation of the Software. You acknowledge and agree that we will not be responsible for any corruption or deletion of your files arising from your installation of the Software and/or use of the Service.
5.4 The Services are provided on an "as is" and "as available" basis and you agree that you use the Services at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you from us or through the Services will create any warranty not expressly set out in this Agreement.
6.1 You will be liable to pay a recurring subscription fee(s) for the Service at the prescribed rate. You will be billed in advance for the subscription fees at monthly intervals or such intervals as may be approved by us. You will be subject to a late payment fee, if payment is not made by the relevant due date.
7.1 If you require onsite assistance for the installation of the Software, you will be charged a service fee of $53.50 (inclusive of GST) per computer. You shall provide us, our employees and contractor’s safe access to your Premises for such installation. You represent and warrant that you are the lawful owner or occupier of such Premises and that you have obtained all necessary permissions to allow us, our employees and contractors to provide such installation.
7.2 During the service call for installation, we are not obliged to render any services apart from installation of the Service.
8.1 The Service is also subject to StarHub’s General Terms & Conditions at www.starhub.com.
8.2 We may from time to time change any of these Terms & Conditions and/or such other terms and conditions agreed or accepted by you. We may also from time to time withdraw, suspend, or change the Service or any part thereof. Such changes will take effect as from such date as we may determine. We will notify you of such changes through written notice, electronic mail, StarHub website or such other form as we may deem appropriate. You agree that the display of the revised Terms & Conditions on StarHub website will constitute notice of the changes. Your continued use of the Service will constitute acceptance of the changes.
8.3 For promotional offers and various subscription or access plans of the Service, special terms and conditions will also apply.
1.1 This Trial is available to all new and existing StarHub Home Broadband postpaid customers who are renewing their home broadband contract. The Trial and the Service shall be applicable for residential use only.
1.2 If you are an eligible customer, you will be entitled a complimentary twelve (12) months trial of StarHub’s SafeShield Service (“Service”) if you sign up for the Service during the promotion period for all new and existing StarHub home broadband postpaid customers who are renewing their home broadband contract. Promotion ends 30 June 2012.
1.3 Each eligible customer will be entitled to a single subscription of the Service comprising of three (3) user licenses. Additional licences required will be payable by the customer.
1.4 The eligibility of a customer to participate in this Trial shall be determined by StarHub at its discretion.
2.1 The Trial will commence from the date that that we send to you the service activation email (“Commencement Date”), regardless of whether you have activated the software product key.
2.2 The Trial and the Service will terminate on the expiry of a continuous period of twelve (12) months from the Commencement Date (“Trial Period”).
2.3 You acknowledge and agree that should you wish to continue to use the Service after the Trial Period, you will have to complete an online application form for the subscription of the Service.
2.4 You acknowledge and agree that in the event that you decide to continue your subscription of the Service after the Trial Period, you will have to pay such applicable charges (including monthly recurring charges) at our prevailing rates.
2.5 You will not be eligible to subscribe to any further free trials of the Service for a period of twelve (12) months after the expiry of the Trial Period.
3.1 This complimentary Trial (regardless of whether it is utilised or otherwise) is non-transferable, non-refundable and not exchangeable for cash or kind or other StarHub products and services.
3.2 This Trial is not applicable with other promotions or discounts unless otherwise specified by us.
4.1 In addition to the terms and conditions herein, StarHub’s General Terms & Conditions and the Service Specific Terms and Conditions – SafeShield (“StarHub’s Terms and Conditions”) shall apply. In the event of any inconsistency between the StarHub’s Terms and Conditions and the terms and conditions herein, the latter shall prevail.
4.2 StarHub reserves the right to amend these terms and conditions at any time without prior notice to you.
4.3 Your participation in this Trial and/or your use of the Service shall constitute your acceptance of the terms and conditions herein and any amendments hereof.
