  1. General
    The use of the StarHub Go Share Value-Added Services are subject to the Specific Terms and Conditions for StarHub Go Services, to StarHub's General Consumer Terms & Conditions, and any other terms and conditions that you and we may have agreed to from time to time. You may view our terms and conditions at Legal Notices & Terms.

  2. Definitions
    1. In these Service Specific Terms and Conditions:

“Charges”

means all subscription, transactional, service charges, administrative charges and other fees and charges to be paid by you for or relating to the Service. The Charges will be in accordance with the rates in our prevailing rate tables available on our website or at our customer service centre; 

“Equipment”

means your personal computer, smart phone, tablet or such other device which you use to obtain or access the Service;

“Family Member”

means a person who: (i) is related to you by family relationship; and (ii) is staying at the same Service Address as yourself; or (iii) meets such other criteria as we may determine from time to time;

“Personal Data”

shall have the meaning set out in StarHub’s Data Protection Policy;

“Services”

means the value-added service currently known as “StarHub Go Share” (or such other name as we deem fit) through which we enable you to permit certain eligible Family Members to have access to your subscription to the StarHub pay television services;

"Territory"

means StarHub Go Value-Added-Services;

  1. Eligibility for the Service
    1. Unless otherwise permitted by us in writing, the Service is only available to you if you:
      1. are resident in the Territory;
      2. have a valid Hub ID;
      3. have a valid and existing subscription to the StarHub pay television service; and
      4. do not have any outstanding payments or debt due to us in respect of any StarHub service.
    2. To be eligible for the Service, each Family Member must:
      1. have their own valid Hub ID;
      2. be resident in the Territory;
      3. be a natural person; and
      4. have a residential address that is the same as your Service Address.
    3. The Service is not available to persons who are not Family Members. In the event that you have permitted or nominated a person who is not a Family Member or who does not meet our eligibility criteria for the Service to use the Service, we may, at our election choose to:
      1. immediately terminate the Service partially for such person or entirely for all Family Members; and/or
      2. charge you the applicable Charges for that person’s use of the StarHub television service for the entire duration that the Service was rendered to that person.
         
  2. Other Eligibility Criteria
    1. If you have multiple accounts registered with us under your name, you will be entitled to subscribe to the Service under only one of these accounts and not for all the accounts.
    2. You must at all times provide us with such information as may be necessary or desirable for us to provide you with the relevant Services

  3. Duration of Services
    1. The Service, and each access to a Family Member, will commence when we accept and confirm your request for the Service or access, as the case may be. Thereafter, the Service will continue until terminated according to the provisions of this Agreement.

  4. Service
    1. Under the Service, you may nominate up to a maximum of four (4) eligible Family Members to access the StarHub Pay television services that you are currently subscribing to. We may, from time to time, increase or decrease the maximum limit of Family Members.
    2. Each of your Family Members must accept your invitation to share your StarHub pay television subscription services, before they can access your StarHub pay television subscription services.
    3. By accessing or using the Service, you agree that each of your Family Members is and will be made subject to these Service Specific Terms and Conditions, and that you will procure their consent to and compliance with these Service Specific Terms and Conditions.
    4. The Service is strictly available only for the corresponding channels, services and content under the StarHub pay television services that you are currently subscribing to provided that such channels, services and content are also available on the StarHub Go internet television service. We reserve the right to determine the content that would be made available on the Service. The Service is not available for any other channels, services or content.
    5. The Service will be made available to your Family Members via:
      1. the valid Hub ID of that Family Member; and
      2. one device at any time for each valid Hub ID, and not simultaneously through multiple devices.
    6. The Service will be delivered to your Family Members via the internet and you acknowledge and agree that availability of the Service is subject to:
      1. internet connectivity; and
      2. the type of devices that you use to access the Service and the software installed in such devices.
    7. We will not be responsible for the internet connectivity (including such networks or platforms, mobile data connection used for internet connectivity), the quality thereof or the devices through which you and/or your Family Members access the Service, each of which may affect the quality of the Service. Without prejudice to the foregoing, we will not be responsible for any Service failure, interruption or performance degradation arising from any failure in internet connectivity, the quality and connectivity of such networks or platforms, mobile data connection and/or the devices through which you and/or your Family Members access the Service, or any lack of compatibility thereof.
    8. The Service is available for viewing only when you and/or your Family Members are within the Territory and cannot be viewed from outside the Territory.
    9. You acknowledge and agree that save and except for the limited permissions on the access to the StarHub Go the Service and Content as expressly provided in these Terms and Conditions, further access to the StarHub Go internet television services is granted to you or any of your Family Members.
       
  5. Use of the Service
    1. You are fully and solely responsible and liable to us for the use of the Service by each and every Family Member and any breach by any of the Family Members of these Terms and Conditions.
    2. Unless otherwise permitted by us in writing, the Service is provided to you solely for your private viewing and the private viewing of your nominated Family Members. You and your nominated Family Members may receive and use the Service in the Territory only, via your respective Hub ID, and for personal, non-transferable and residential use only. You must not, and you must ensure that your Family Members must not exhibit in public or collect any fees for the exhibition of the Content in the Service. Unless otherwise permitted by us in writing, any use of the Service for commercial or business purpose or any other non-residential use, whether by you, your Family Members or any other person in your name is a breach of your terms of use of the Service.
    3. You and your Family Members must view the content received as part of the Service in their entirety. You will not, and you will ensure that your Family Members will not, for any purpose whatsoever, alter, reproduce, edit, supplement, omit or circumvent any channel or programme received as part of the Service, including the insertion of crawlers or advertisements immediately before, during or after the exhibition or broadcast of the channel or programme.
    4. Your use of the Service and that of your Family Members is subject to any instructions, notices and directions as may be determined by us from time to time.
    5. We may, at any time and without any notice to you and/or your Family Members, temporarily suspend the Service for operational reasons such as repair, maintenance, upgrade or improvement of the Service or because of an emergency. We will restore the Service as soon as reasonably practicable. We may also modify the Service in order to keep pace with the prevailing demands and technological developments, at our discretion and without any notice to you or your Family Members.
       
  6. Content and Your Responsibilities
    1. We retain the sole right and discretion to determine the type, nature, genre, quality and quantity of Content made available on or through any of the Service.
    2. You are responsible for the use of the Service under your account(s) and for any Content disseminated through your account(s) whether or not it was actually used by you or your Family Members.
    3. You must not use or allow any part of the Service to be used (whether by your Family Members or otherwise):-
      1. to transmit or post any Content which may be defamatory, offensive, indecent, objectionable or illegal, or which may cause annoyance, harassment, irritation, inconvenience or anxiety to anyone. This includes transmitting or posting "junk mail", "spam", "chain letters", "solicitations" (commercial or non-commercial) or distributing mail to any party who has not given permission to be included in the distribution;
      2. to transmit or post any Content which may give rise to civil liability or otherwise violate any applicable laws, rules or regulations;
      3. to transmit any Content that contains viruses, worms, trojan horses, time bombs, cancel bots or any other harmful, damaging or destructive programs;
      4. to make or attempt any unauthorised access to any part or component of the Service, the Network or any third party systems or networks to which you can connect through the Service directly or otherwise;
      5. to disrupt the various networks that are connected to the Service or violate the regulations, policies or procedures of such networks;
      6. to collect and/or disseminate information about others or their email addresses without their consent;
      7. for any fraudulent, illegal or improper purposes or to violate anybody's rights or in any way which may affect other users' enjoyment of or access to any of the Service or cause annoyance, harassment, irritation, inconvenience or anxiety to anyone;
      8. in any manner or for any purpose which may constitute a violation or infringement of the rights of any party including but not limited to their intellectual property or confidentiality rights;
      9. to be resold or otherwise provided to third parties without our prior written consent, whether for profit or not;
      10. to transmit any Content received under the Service to any other personal computer, laptop, mobile phone or other similar device(s) (other than your Equipment) unless otherwise permitted by us; and
      11. to transmit any Content received under the Service outside the geographic boundaries of Singapore unless otherwise permitted by us.
    4. You acknowledge and agree that through your use of the Service, you or any of your Family Members may encounter Content which may be deemed offensive, indecent, or objectionable, which Content may or may not be identified as such. You and your Family Members agree to use the Service at your sole risk and that we will not have any liability to you or your Family Members for the type of Content that may be accessed through the Service, including without limitation Content that you and/or your Family Members may find offensive, indecent, or objectionable.
    5. You and your Family Members acknowledge and agree that the Content accessed through the Service may be altered with technology and/or rules which protect digital information from access and may limit or restrict your respective usage of Content to certain usage rules as may be determined by us and our licensors (the "Usage Rules"). You agree to comply with and procure your Family Member’s compliance with the Usage Rules. The Usage Rules may be controlled and monitored by us for compliance purposes, and we reserve the right to enforce the Usage Rules with or without notice to you and/or your Family Members as the case may be.
    6. The Service is a streaming Service and no Content shall be downloaded at any time for any reason.
       
  7. Billing
    1. The following Charges will be applicable for the Service:
      1. $5.35 per month for you as the subscriber of the Service; and
      2. $5.35 per month for each Family Member whom you permit to access your StarHub pay TV services.
    2. All Charges will be billed to you as the account holder upon the commencement of the Service regardless of whether or not any of your Eligible Family Members have activated their access to your StarHub pay television subscription service. You shall be liable for payment of all the Charges applicable to the Service, including those of your Family Members.
    3. The $5.35 Charge to you as the subscriber of the StarHub pay television services under Clause 9.1.1 above is waived for a limited period from now until 31 December 2016 or such other extended date as we may notify, after which the Charge will be resumed without further notice to you.
    4. If you or any of your Family Members are a subscriber of StarHub post-paid mobile services, each of you would have to set your mobile data access point on your device (APN) to “shwap” in order to enjoy a limited waiver of data charges when accessing the Service using your StarHub mobile services. Such limited waiver shall be made available and determined by us from time to time and on such terms as we deem fit. This limited waiver of data charges is not applicable if you and/or your Family Members are accessing the Service via an access point of “shinternet” even if you are a subscriber StarHub post-paid mobile services.
    5. You will be billed in advance for the subscription fees at monthly intervals or such intervals as may be approved by us. You will be subject to a standard late payment fee if payment is not made by the relevant due date.
    6. Any change in the method of payment will only be effected from the next billing cycle onwards.
    7. The applicable Charges for the Service do not include internet connectivity charges, data charges or such charges necessary for your connection to the internet in order to access the Service. You and each of your Family Members will have to bear such charges from the relevant providers of internet connectivity, at their prevailing rates.
    8. From time to time, we may from offer a discount or a waiver on the applicable mobile data charges for our mobile data services where our mobile data services are used by you to access the Service, on condition that certain stipulated criteria and terms are met. In such event, we would not be liable to grant any discount or waiver of the applicable mobile data charges unless all our stipulated criteria and terms have been duly met.
    9. The Charges are inclusive of Goods and Services Tax.
       
  8. Equipment
    1. In order to access the Service, you and your Family Members must acquire and procure such Equipment as may be necessary to for you to access the Service.
    2. You are responsible for ensuring that the Equipment that you and each of your Family Members have, meet the specifications and minimum system requirements for the Service as may be stipulated by us, and that they are compatible and may properly function and access the Service. We will not be liable for any Equipment or Service failure or performance degradation resulting from the non-compliance of such requirements as set by us from time to time. You acknowledge and accept that certain applications are not supported by the Service.
    3. You represent and warrant that you are and each of your Family Members is the lawful owner or authorised user of the Equipment, and that you have each obtained all necessary permissions to allow us, our employees and contractors to provide Software for such Equipment.
       
  9. Personal Data Protection
    1. The use of the Service by you and each of your Family Members is subject to StarHub’s Data Protection Policy. By using or continuing to use the Service and the Additional Services, you and each of your Family Members agree and consent to be bound by the terms of StarHub’s Data Protection Policy.

  10. Liability
    1. The Service are provided on an "as is" and "as available" basis and you agree and accept that the use of the Service or the reliance on any Content obtained through the Service by you and/or your Family Members is at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you and/or your Family Members from us or through the Service will create any warranty not expressly made in this Agreement.
    2. We do not warrant to you or to any of your Family Members that the Service or the Content are error free or are free of any unauthorized code, software virus, Trojan Horse, worm, logic bomb or other software routine or components designed to permit unauthorised access, to deny authorised use, to disable, erase, or otherwise harm software, hardware or data, or to perform any unauthorised actions.
    3. If you or any of your Family Members are dissatisfied with any of the Service or with the Content, products or services available on or through any of the Service or with any of the terms and conditions of this Agreement, your sole and exclusive remedy is to discontinue accessing and using the Service or terminate the Service according to this Agreement.
       
  11. Proprietary Rights
    1. All Content contained in advertisements or sponsorships presented to you and to your Family Members through the Service by us, our advertisers, content/applications providers or third parties, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You agree that you and your Family Members are only permitted to use such Content as expressly authorised by us, the advertiser, the provider or third party in question.
    2. You and your Family Members are not permitted to copy, reproduce, distribute, or create derivative works from such Content without written authorisation from us, the advertiser, the provider or third party in question.
    3. You acknowledge and agree that save and except for the limited permissions on the use of the Service and Content as expressly provided in these Terms and Condition, no right, title or interest in any of the Content shall be deemed transferred to you and/or any of your Family Members through the provision of the Service or through access to the Content that you and/or any of your Family Members obtain through the Service.
       
  12. Ending the Service
    1. Without prejudice to the rights either party may have against the other party under this Agreement for any antecedent breach of this Agreement and subject to the provisions of this Clause 16, the Service under this Agreement or this Agreement may be terminated in the following manner unless otherwise agreed in writing by you and us:
      1. by you giving us prior notice of at least 7 working days; or
      2. by us giving you prior notice of 7 working days.
    2. If the Service or this Agreement is terminated for any reason, there will be no refund of any pre-payments or payments in advance made by you.
    3. In the event of any of the following:
      1. you breach any of the terms and conditions of this Agreement or any other agreement you have with us;
      2. you breach the terms of use of each Service under these Specific Terms and Conditions;
      3. you become or threaten to become bankrupt or insolvent, or die;
      4. you make any arrangement or composition with or assignment for the benefit of your creditors or go into either voluntary or compulsory liquidation or a receiver, trustee, judicial manager or administrator is appointed over any of your assets;
      5. the equivalent of any of the events referred to in paragraphs (c) and (d) above under the laws of any relevant jurisdiction occurs to you;
      6. you provide incorrect, false or incomplete information to us;
      7. the requirements of any relevant regulatory authority result in us having to stop providing the Service, or to provide the Service in a manner which is unacceptable to us;
      8. If you are likely to create imminent harm (such as interruption, disruption, congestion, signal leakage and any Unauthorised Act) to our Network or any third party's networks or systems or our provision of the Service, or defraud us, or are likely to create imminent harm or are abusive to our personnel; or
      9. for any reason beyond our control (including loss of any licence, way-leave or easement, requirements of any governmental or regulatory authority or orders by the court and failure to deliver by a third party supplier) we are unable to provide the Service, we may suspend or terminate all, any or part of any of the Service or terminate this Agreement with 2 working days' notice (for paragraphs 14.3.1, 14.3.2 and 14.3.6 above) or with immediate effect (for paragraphs 14.3.3, 14.3.4, 14.3.5, 14.3.7, 14.3.8 above) without compensation and without prejudice to our rights to damages for any antecedent breach by you of this Agreement. You may immediately contact our customer service, either by calling our customer service line or visiting any of our customer service centres to tell us why such suspension or termination should not occur. We will consider each case and where we deem appropriate, will not proceed with the suspension or termination of such account or take any other appropriate action where necessary.
    4. In the event that we suspect that you are using or allowing any of the Service to be used for fraud, misconduct or any other illegal or improper purpose, we will refer this to the relevant authorities without notice to you and comply with directions or guidelines issued by them without further reference to you.
    5. If and when you make good any breach or default, we may restore any suspended or terminated Service after you have paid for any restoration or re-connection Charges and reimbursed us for our reasonable costs in suspending or terminating the Service.
    6. If a Service is terminated all sums due, accruing due or payable to us in respect of the Service will, upon the termination, become immediately due and payable to us.
       
  13. Changes
    1. We may change any part of the Service in such manner as we may determine in our absolute discretion. We may also from time to time revise the Charges for the Service. Your continued use of the Service or that of any of your Family Members shall be deemed acceptance of the changes.
