  1. Definitions
    1. In this Section:
      1. “App” means the mobile application known as ‘SmartWallet’ provided by StarHub, which allows mobile commerce services and transactions offered by Third Party Service Providers to be made using Near-Field-Communication (“NFC”)-enabled mobile handsets operating on Android systems. The App is made available for download at the Google Play online application store.
      2. Third Party Service Providers” means any merchant or service provider that owns and operates the products and/or services associated with the Mobile Coupon and the Mobile Ticket programmes and the NFC Payment Card service accessible via the App as part of the SmartWallet Service.
      3. Mobile Coupon” means the feature provided by the App as part of the SmartWallet Service that allows the download, storage and usage of a digitally encoded coupon for exchange of discounts or rebates during a NFC payment transaction at a retail store authorized by the Third Party Service Provider of the mobile coupon.
      4. Mobile Ticketing” means the feature provided by the App as part of the SmartWallet Service that allows the purchase, storage and usage of a digitally encoded ticket for exchange of a service at a retail store authorized by the Third Party Service Provider of the mobile ticket.
      5. "NFC Payment Card" means a virtual credit card, debit card, transit pass, or any type of stored-value card in the form of a mobile application provided by PSPs and PCSPs that is stored in the NFC SIM, which can be used  to make cashless payments using NFC through the App.
      6. NFC SIM” means the SIM card enabling NFC payment transactions that is required to be installed onto your NFC-enabled mobile handset for use of the App.
      7. PCSP” refers to a payment card scheme provider, which owns the trademarks of payment cards (credit, debit or prepaid cards), and whose principal business is to process payments between the merchants’ banks and the card issuing banks or credit unions of the purchasers who use the payment cards to make purchases.
      8. PSP” refers to a payment service provider who issues and provides the NFC Payment Card that allows cashless payments to be made through the App.
      9. SmartWallet Service” shall mean the App, which allows you to make contactless payment transactions through the NFC Payment Cards, and access and use the Mobile Coupons and the Mobile Ticketing, subject to the terms and conditions herein. 
  2. Eligibility
    1. Only StarHub mobile post-paid customers will be eligible to apply for the SmartWallet Service. 
    2. For any eligible customer who wishes to make NFC payment transactions using the App, he or she is required to purchase a NFC SIM and use it on an approved NFC-enabled mobile handset. The list of approved NFC-enabled handsets is made available on StarHub’s website at www.starhub.com/smartwallet, and is subject to update from time to time.
    3. For individuals, you must be at least 18 years old. If you are below 18 years old, please seek the consent of your parent or guardian before using the SmartWallet Service. 
    4. At the time of application, you must not have any outstanding accounts with us that are due and owing to us.
    5. We may decline acceptance of your application at our discretion.
  3. Use of the App
    1. You are granted a limited, non-exclusive and non-transferable license to the App to access the SmartWallet Service. 
    2. The NFC Payment Card that is presently available under the SmartWallet Service is the NFC EZ-Link purse. 
    3. By using the NFC Payment Card, you agree that you may be subject to terms and conditions imposed by the relevant PSPs and PCSPs (including any applicable service charges imposed by them). You further acknowledge and agree that StarHub is not responsible for, and accepts no liability whatsoever in relation to the NFC Payment Cards and any payment transactions made using the NFC Payment Cards.
    4. We reserve the right to impose from time to time such service charges for the SmartWallet Service, including without limitation any fees for service activation, NFC SIM, NFC Payment Card and any replacement of such cards.  
    5. You are solely responsible for the security of your SmartWallet Service account or any information relating to your SmartWallet Service account. You shall immediately notify us of any unauthorised use of or any breach of security relating to the App, SmartWallet Service account or NFC SIM. You are solely responsible for all transactions and activities that occur under your login identification and/or your account, whether such transactions or activities were carried out with your express consent and/or knowledge or otherwise.
    6. In the event that your NFC SIM is lost or stolen, you must notify the relevant PSPs and/or PCSPs and us immediately for the suspension of the NFC Payment Card and the NFC SIM respectively. We shall not be liable for any delay or failure on your part in doing so. You may request for replacements of the NFC SIM and NFC Payment Card for an applicable fee.
    7. In the event that you decide to port your mobile number from or to another mobile operator or transfer your StarHub post-paid mobile service account to another person, you shall ensure that the NFC Payment Card stored in the relevant NFC SIM Card (provided by the existing mobile operator) is terminated prior to the date the number port or service account transfer takes effect. We shall not be liable for any failure or delay on your part in doing so.
    8. You agree that the SmartWallet Service may enable you to access, use or acquire third party products and services. Our General Consumer Terms and Conditions, which you confirm you have read and agree to, explain our position on such third party products and services. You further agree to comply with any additional third party terms and conditions applicable to the use of such third party products and services. 
    9. Any claim, dispute or matter arising under or in connection with the NFC Payment Cards and the transactions for the products and services provided by the Third Party Service Providers, is to be resolved directly by you with the relevant PSP, PCSPs and/or Third Party Service Providers. Any such claim, disputes or matter relating to the NFC Payment Card may include, but shall not be limited to, the following:
      1. transactions using the NFC Payment Card for top up or payment transactions, whether caused by the payment service applications residing in the NFC SIM, faulty payment terminals, backend systems owned and/or operated by the PSPs and/or PCSPs or otherwise;
      2. refund of any stored value associated with the NFC Payment Card;
      3. transactions relating to the usage of Mobile Coupon and Mobile Ticketing  provided on the App; and
      4. termination of NFC Payment Card.
    10. Notwithstanding any provision herein, the SmartWallet Service  is provided on an “as is" and "as available" basis and you agree that you use the SmartWallet Service at your sole risk and we do not guarantee the security of any transaction performed using the SmartWallet Service. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you from us will create any warranty not expressly set out in this Agreement.
  4. Privacy and User Data
    1. You confirm that you have read and agreed with our Privacy Policy and Personal Data Protection Policy set out in our website at http://www.starhub.com/.
    2. We may collect, use and disclose your personal data for the purposes set out in the StarHub Personal Data Protection Policy, which may be found at http://www.starhub.com/, including the StarHub Additional Purposes and the Preferred Partner Additional Purposes. 
    3. In particular, we will collect, use and disclose your personal data for the following purposes:    
      1. to send you marketing offers and promotions (whether for StarHub services and products, or those of our partners); and
      2. purposes which are reasonably related to the aforesaid. 
    4. To withdraw your consent to the StarHub Additional Purposes and the Preferred Partner Additional Purposes, or for any other enquiries, you may contact our Data Protection Officer at dpo@starhub.com.
    5. You confirm that all the information which you have provided in connection with the SmartWallet Service or these Terms and Conditions are current, true, accurate, supportable and complete. You agree to inform us immediately of any changes to the information, including but not limited to any changes in your address and/or contact particulars.
  5. Applicability of Terms
    1. By installing the App, you represent and warrant to us that you accept the Terms and Conditions set out above (“SmartWallet Terms & Conditions”), which are in addition to our Mobile App Terms and Conditions and General Consumer Terms and Conditions (“General Terms & Conditions”) set out on our website at www.starhub.com, and any other terms and conditions that you and we may have agreed on from time to time (“Agreement”).
    2. You agree that we may amend this Agreement from time to time and will post the modified Agreement at our website at www.starhub.com. If you do not agree to the modified Agreeemnt, you should stop using the SmartWallet Service. Your continued use of the SmartWallet Service after the date of the modified Agreement is posted will constitute your acceptance of the modified Agreement.
