Terms & Conditions - My Happy Account Online Top-Up Service


  1. Services
    1. In this Terms and Conditions, “Services” refer to payment and top up services for pre-paid card through the purchase of air-time or a variety of data product subscriptions provided by StarHub Mobile Pte Ltd (Reg. No. 200000646C) on www.starhub.com.
    2. On behalf of Starhub Mobile Pte Ltd (Reg. No. 200000646C), Mi-Pay Pte Ltd (Reg. No. 201227264K) (“Mi-Pay”) will provide a payment gateway through which you can order and make payments for the top up services.
    3. Mi-Pay acts as the commercial agent for Starhub Mobile Pte Ltd solely in relation to the provision of the Services only. Mi-Pay is not authorised to act on behalf of StarHub Mobile Pte Ltd or its affiliates with regards to any other transaction or service.
  2. Acceptance 
    1. These Terms and Conditions will apply when you access the Services. Before proceeding to use the Service, please read these terms and conditions carefully. If you are unable to accept these Terms and Conditions, please do not click on the “Accept” button that appears at the end of the Registration Page.
  3. Provision of the Service
    1. Prior to using this Service, you must provide your registration details for the Service by completing the online registration process. We will notify you of our acceptance of your registration by email and/or SMS text message and/or on screen on the web page. These Terms and Conditions apply on every occasion that you use the Service. We may decline acceptance of your application at our discretion.
    2. By registering and/or using this Service, you acknowledge and agree that this Service may be provided by a third party provider, Mi-Pay Limited (“Mi-Pay”) on behalf of StarHub, and further that any information (including Registration Data) that you provide may be disclosed to this third party provider for the provision of the Service. Mi-Pay’s use of your information will be subject to Mi-Pay’s Privacy Policy available at https://prepaidtopup.starhub.com/SelfCare/Registration/PrivacyPolicy.aspx.
    3. You represent and warrant that all information that you provide to us and Mi-Pay in connection with the Service, including but not limited to your Registration Data will be complete and accurate in all respects and you acknowledge that we and Mi-Pay are wholly reliant on the accuracy of the Registration Data you provide and will rely on it in the provision of the Service to you. “Registration Data” shall refer to your name, address, email address, date of birth and payment details. Some of these data may be optional depending on the type of Services chosen.
    4. Upon acceptance of your registration, you will be allocated a personalised account for the use of the Service (“Account”). You are responsible for the use of the Service under your Account, including without limitation, the security of your Account and its associated passwords and PIN numbers.
    5. Certain type of Services, known as Unregistered Topup, will not result in an Account being set up for you, and you will not be required to provide a password or PIN to access the service. However, you must still provide data that is complete and accurate in all respects.
    6. In order to become a registered user, you must supply a valid credit or debit card and you must provide certain information to us to enable Mi-Pay to validate your identity and verify that you are the owner of, or an authorised user of, such credit or debit card(s). You will also have to provide Mi-Pay with details such as your postal address, and a valid email address. Each User may register one Account. The information that you provide may be validated against information we already have on file that is associated with you, your credit or debit card, your bank account, your StarHub account, or information we receive from one or more third parties, or information maintained by a third party. If you are unable to provide adequate information for us to validate your identity or the authority of the holder of the Account, we have the right to not allow you to register for the Service. You warrant that the information is correct and that you have the legal right to use all of the credit or debit cards and all of the bank accounts you register for this Service.
    7. By signing up for this Services, you agree to (i) provide true, accurate, current and complete information about yourself as prompted by the online registration form, and (ii) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any Registration Data that is untrue, inaccurate, not current or incomplete, or if we have reasonable grounds to suspect that your Registration Data is untrue, inaccurate, not current or incomplete, we have the right to suspend, terminate, or refuse your current or future use of the Services.
    8. Activation of the Service will be deemed to have occurred upon confirmation that your registration was accepted either:
      1. being presented to you on the web site that you accessed to register for this Service, or
      2. sending of an email to your email address entered on your Registration Data, or
      3. where you successfully request a payment for a service and receive that service; this includes services where registration is not required.
  4. Your use of the Services
    1. You are responsible for obtaining any equipment required for your use of the Services, including a suitable computer with Internet access and web browser and any other items of hardware or communications equipment necessary to enable you to access and use the Services. You acknowledge and agree that the ownership in any intellectual property rights (including, for the avoidance of doubt, copyright) in this website and Service belongs to us or our licensors. Accordingly, any part of this website (or its source HTML code) may not be used, transferred, copied or reproduced in whole or in part in any manner other than for the purposes of utilizing this website meaning that you may only display it on your computer screen and print it out on your printer for the sole purpose of viewing its content.
    2. You can use the Services to order prepaid top-ups and purchase data plans for your registered StarHub pre-paid mobile accounts. The nominated mobile account will be updated to reflect the service ordered by you shortly after you place your order. You will not be able to cancel an order once a top-up is ordered and accepted by us. In the event that your StarHub pre-paid mobile service used to register for an Account has expired or been terminated, your Account will be automatically closed. You will be required to register for a new Account to use the Service.
    3. You can review the personal information you provided to us and make any desired changes to such information, or to the settings for your Account, at any time by logging in to your Account at My Account and changing your preferences. You can also close your Account by contacting Customer Services. If you close your Account, your personally identifiable information will not be used by us for any further purposes, nor sold or shared with unrelated third parties, except as necessary to prevent fraud and assist law enforcement, or as required by law.
    4. You agree that Mi-Pay shall be entitled to assign or transfer any or all of its rights and obligations under this Agreement to its affiliates or any entity, provided that the succeeding or transferee entity agrees to be bound by this agreement and all terms and conditions set out herein.
  5. Charges and payment
    1. By placing your order, you authorise Mi-Pay to take the relevant payment by your chosen payment method. Transactions will appear on your bank account as “StarHub Prepaid”.
    2. If we are unable to collect payment through your chosen payment method, we will normally not provide the top-ups that we have requested. However, if we have already supplied the top-ups to you before we receive notification of the failure of the payment, we will attempt to remove the top-up value from your account. If we are unable to remove the top-ups from your account because you have used or started to use it, then we reserve the right to collect the funds from another payment method or service account that you have registered with us.
    3. We may set an upper limit of total amounts you may order through your Account, and reserve the right to amend this limit at any time without notifying you.
    4. You must not knowingly order a service when there are insufficient funds in your bank account or insufficient credit on your credit or debit card to allow Mi-Pay to collect payment successfully on behalf of StarHub.
    5. Where an order to purchase Starhub services through Mi-Pay has been placed and accepted, you will not be able to cancel that order through Mi-Pay.
    6. You understand and accept that when you top-up your prepaid card online at the StarHub Prepaid Online Top Up webpage, certain credit card companies may impose a cross-border charge on the payment of your top-up transaction. Please check with your relevant credit card company on the applicable charges, terms and conditions. Depending on the policy of the relevant credit card company that you use, you may or may not receive prior notice of the cross-border charge.
  6. Use of your information
    1. When you first provide us with details of your credit and / or debit cards during the registration process, they may immediately be authenticated on line by the card issuers, using our secure facilities. You acknowledge and agree that changes to the details of your credit and / or debit cards may be immediately authenticated on line by the card issuer.
    2. Payment details you provide during the registration procedure will be encrypted and stored on a secure server.
    3. We reserve the right to restrict your access to the Service, should we and/or Mi-Pay consider that the activities or the changes of personal or payment data on the Account breaches the risk business rules associated to the Service. The risk business rules monitor changes made to your personal and payment details held on your Account, the volume and value of top-ups requested through your Account and the failure of collection of payment for the authorised top-ups.
    4. You agree that we may communicate with you on a regular basis via email or SMS to provide requested services, inform you of updates regarding your Account and we also may communicate by phone to resolve complaints or investigate suspicious transactions. We may use your email address to confirm your registration to our Prepay TopUp Service and notify you of transactions when carried out. You also agree that we may use your email address to send you information about important changes to our products and services, and to send notices and other disclosures required by law or payment scheme rules.
    5. We will use the personal data you provide with your Registration Data, together with transactional data (but not your personal financial details) for the purposes such as:
      1. processing your registration;
      2. administration of the Service; and
      3. statistical purposes to improve the Service.
    6. You consent to our sharing of your personal information with Mi-Pay for the purposes described in these terms and conditions, including the provision of the Service. By registering for and/or using the Service, you also agree to Mi-Pay’s Privacy Policy available at https://prepaidtopup.starhub.com/SelfCare/Registration/PrivacyPolicy.aspx.
  7. Restrictions on Use
    1. You must not use or allow any part of the Services to be used:
      1. to transmit or post any content which may give rise to civil liability or otherwise violate any applicable laws, rules or regulations;
      2. to transmit any content that contains viruses, worms, trojan horses, time bombs, cancelbots or any other harmful, damaging or destructive programs;
      3. to make or attempt any unauthorised access to any part or component of the Services, the Network or any third party systems or networks to which you can connect through the Services directly or otherwise;
      4. to disrupt the various networks that are connected to the Services or violate the regulations, policies or procedures of such networks;
      5. to collect and/or disseminate information about others or their email addresses without their consent;
      6. for any fraudulent, illegal or improper purposes or to violate anybody's rights or in any way which may affect other users' enjoyment of or access to any Service or cause annoyance, harassment, irritation, inconvenience or anxiety to anyone;
      7. in any manner or for any purpose which may constitute a violation or infringement of the rights of any party including but not limited to their intellectual property or confidentiality rights; and
      8. to be resold or otherwise provided to third parties without our prior written consent, whether for profit or not.
  8. Security
    1. You are solely responsible for the security and secrecy of your login identification, password(s) or PIN given to or chosen by you. You must ensure that these are not revealed to any third party. You are solely responsible for all activities that occur under your login identification, password(s), PIN and/or your Account.
    2. We reserve the right to refuse, change or remove login identification, password(s) or PIN which we deem inappropriate or offensive.
    3. If you discover or suspect any unauthorised use or disclosure of your login identification, password(s) and/or PIN or that your Account security has been compromised, you must immediately:
      1. inform us; and
      2. change your password(s) and/or PIN.
    4. You are advised to change your password(s), PIN or any other security identification regularly to protect your own security.
    5. The security of your Account is your own responsibility. We cannot guarantee the safety and security of any transmission.
    6. You agree to update us immediately with any changes to the information you give to us during the registration process including any changes to your Account details.
  9. If you terminate this agreement
    1. We can suspend the Service or terminate this Agreement (or both) immediately if:
      1. you breach this Agreement;
      2. we believe that the Service is being used in breach of your obligations herein;
      3. we determine that your Account is inactive;
      4. bankruptcy or insolvency proceedings are brought against you, or an arrangement with creditors is made, or a receiver or administrator is appointed over any of your assets, or you go into liquidation;
      5. one or more than one payment resulting from your order of a top-up cannot be collected successfully by Mi-Pay on behalf of StarHub;
      6. payments collected successfully by Mi-Pay on behalf of StarHub from your order of a top-up are subsequently disputed by you or your card issuer or your bank and the monies for the aforementioned payment are returned to you or your card issuer or your bank;
      7. we receive an advice from your bank that your payment details are no longer valid;
      8. that your mobile network service with StarHub has been suspended or terminated.
      9. We may seek to recover any outstanding payments or payments that have failed collection for which you will remain liable.
  10. Liability
    1. The Services are provided on an "as is" and "as available" basis and you agree that you use the Services or rely on any Content obtained through the Services at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you from us or through the Services will create any warranty not expressly set out in this Agreement.
    2. Without prejudice to Clause 10.1 above, we make no warranty:
      1. that the Services will not cause any harm to your system or Content;
      2. as to the accuracy, reliability or quality of any Content obtained through the Services or that defects in any Software will be corrected; and
      3. that the Services and access to them are error free and uninterrupted or available at all times.
    3. Except as set out in this Agreement, we expressly exclude all other liability we may have to you, including all liability in contract, tort, negligence, misrepresentation, strict liability or statute. This exclusion applies for our benefit and that of other Service Providers whose networks are connected to each other or to the Network, all companies, directly or indirectly owned, wholly or partly owned or controlled by us or any of these parties, and all their officers, employees, contractors and agents or anyone else to whom we or these parties are responsible ("the Relevant Parties") and whether it relates to anything caused by or resulting from anything any of the Relevant Parties does or omits to do or delays in doing (even if done, omitted or delayed wilfully, recklessly or negligently), whether or not it is contemplated or authorised by any agreement you have with us.
    4. Under no circumstances will we or any of the Relevant Parties be liable for any special, incidental, indirect, consequential or punitive damages, losses, costs or expenses, even if such damages, losses, costs or expenses were caused wilfully, recklessly or negligently.
    5. Under no circumstances will we or any of the Relevant Parties be liable for any lost profits, revenue, business or anticipated savings, even if such damages, losses, costs or expenses were caused wilfully, recklessly or negligently.
    6. If we or any of the Relevant Parties are liable to you and we cannot, for any reason, rely on the exclusion of liability set out in Clauses 12.3 to 12.5 above, then in no event will our liability for damages, losses, costs or expenses suffered or incurred by you and anyone else (whether in contract, tort, negligence, misrepresentation, strict liability or statute or otherwise) exceed S$1,000/- in any 12-month period.
    7. The limitations and exclusions of liability in this Agreement shall not apply to any liability we or any of the Relevant Parties may have in respect of any death or personal injury resulting from our negligence.
    8. The limitations and exclusions of liability in this Agreement shall not apply to any liability which cannot be lawfully excluded or restricted under the Unfair Contract Terms Act (Cap. 396).
    9. StarHub Ltd or any Affiliate may perform any of its obligations or exercise any of its rights under this Agreement by itself or through StarHub Ltd or any other Affiliate. However, any act or omission of any such other Affiliate is deemed the act or omission of the party providing the Services.
  11. Indemnity
    1. You must indemnify us, our Affiliates, employees, directors and agents against all claims, damages, losses and liabilities resulting from your use of the Services, your negligence, omission, act or breach of this Agreement.
  12. Other 
    1. In addition to these terms and conditions, you agree that StarHub's General Terms & Conditions, any applicable Service Specific Terms & Conditions, and StarHub’s Legal & Privacy Statement (collectively “StarHub Terms”) shall apply.
    2. We may from time to time change any of these Terms & Conditions (including the StarHub Terms) and/or such other terms and conditions agreed or accepted by you (including, without limitation, our tariffs, price plans, Charges and payment terms). We may also from time to time withdraw, suspend, or change any of the Services. We endeavour, where reasonably practicable, to give you reasonable advance notice of such changes. We will notify you of such changes through written notice, electronic mail, our bill, our website or such other form as we may deem appropriate. You agree that the display of the revised Terms & Conditions (including the StarHub Terms) on our website will constitute notice of the changes. Your continued use of the Services will constitute acceptance of the changes.
