Terms & Conditions - Music Anywhere Service


By clicking on the “Accept” or similar button, you represent and warrant to us that you accept the terms and conditions set out below (“Music Anywhere Terms & Conditions”), which are in addition to our General Consumer Terms and Conditions (“General Terms & Conditions”) set out at Legal Notices & Terms and any other terms and conditions that you and we may have agreed on from time to time (“Agreement”).

All definitions used herein shall be the same as that in the General Terms & Conditions, unless indicated or the context suggests otherwise

  1. Definitions
    1. In this Section :
      1. "Charges" refers to any and all activation/connection, disconnection, reconnection, subscription, installation, service call, usage, and administrative charges and other fees to be paid by you for or relating to the Services. The Charges will be in accordance with the rates in our prevailing rate tables available on our website.
      2. "Content" refers to all text, sounds, music, videos or other media and data streamed, downloaded or otherwise accessed by you via the Services.
      3. "Licence" refers to the licence described in these Music Anywhere Terms & Conditions.
      4. "Services" refers to StarHub’s Music Anywhere Services, which allow you to stream and otherwise access music, connecting tones and other media, as well as access related social media services, subject to terms and conditions herein.
      5. "Software" refers to any software provided to you as part of or through the Services, or which allow you to access or use the Services, including any software upgrades or updates.
      6. "Intellectual Property" refers to the copyrights, patents, trade marks, tradenames, logo, service marks and other intellectual property or proprietary rights in or available through the Services.
  2. Licence
    1. We hereby grant you a revocable, personal, non-commercial, non-exclusive and non-transferable Licence to use the Software to access the Services, subject to the terms and conditions set out herein.
    2. You shall not:
      1. Use, download, or copy the Software other than as permitted by these Music Anywhere Terms & Conditions;
      2. Rent, lease, lend, sell, redistribute, sublicence or otherwise transfer the Software;
      3. Copy, reproduce, translate, adapt, vary, modify, reverse engineer, disassemble, attempt to derive the source code of or create derivative works of the Software or any part thereof except only to the extent that the applicable law provides that such cannot be prohibited; or
      4. Use the Software for any unlawful purpose or any other purpose not authorised by these Music Anywhere Terms & Conditions.
  3. Eligibility for Services
    1. For individuals, you must be at least 18 years old.
    2. At the time of application, you must not have any outstanding accounts with us that are due and owing to us.
    3. We may decline acceptance of your application at our discretion.
  4. Duration of Service
    1. The Licence shall continue unless and until terminated in accordance with this Agreement, or as otherwise agreed by us.
    2. The Licence shall terminate automatically if you fail to abide by any term in this Agreement.
  5. Billing
    1. You may be liable to pay Charges for the Services at the prescribed rate(s) notified by us. In particular, data and/or roaming subscription charges will apply when accessing the Services via your mobile devices or overseas, as the case may be.
    2. You will be billed in advance for the Charges or at such intervals as may be approved by us. You will be subject to a standard late payment fee if payment is not made by the relevant due date set out in the invoice.
    3. You may pay through your credit card, GIRO or though any third party designated by us. Any change in the method of payment will only be effected upon approval by the relevant financial institution of your application for the new method of payment.
    4. Billing and payment disputes that may be raised by you will be treated in accordance with the General Terms and Conditions.
  6. Termination
    1. You may terminate this Agreement or your subscription to any part of the Services with immediate effect through the Music Anywhere Portal. There will be no refund of any subscription fees or any Charges which have been paid for the Services prior to termination.
    2. We may, at our sole discretion and without notice to you, restrict, suspend or terminate the Licence and/or the Services without assigning any reason.
  7. Competition, Promotions and Surveys
    1. From time to time, we may run competitions, promotions and surveys via the Services, subject to additional terms and conditions. You further agree to comply with any additional and/or third party terms and conditions applicable to such competitions, promotions and surveys. 
  8. Third Party services, products and Content
    1. The Services may enable you to access, use or acquire third party products, services and Content. Our General Terms & Conditions, which you confirm you have read and agree to, explains our position on such third party products, services and Content. You further agree to comply with any additional third party terms and conditions applicable to the use of such third party products, services and Content.
  9. Security
    1. We shall not be responsible for the security of information transmitted to, from or through the Services.
    2. You shall be responsible for ensuring the security of any network, account or Equipment used to access the Services. You shall immediately notify us of any unauthorized use of or any relevant breach of security relating to the Services, network, account or Equipment.
    3. You shall use secure passwords to protect any network, account or device used to access the Services. Use of passwords deemed by us, in our sole discretion, to be insecure shall be a violation of these terms and conditions.
  10. Privacy and User Data
    1. You confirm that you have read and agree with our Privacy Policy set out in our website.
    2. You confirm that all the information which you have provided in connection with the Services or these terms and conditions are current, true, accurate, supportable and complete. You agree to inform us immediately of any changes in this information, including but not limited to any changes in your address and/or contact particular.
  11. Intellectual Property
    1. The Intellectual Property in the Software and any Content are owned by us and/or our licensors. Save as provided under this Agreement, you will not acquire any right in any and all Intellectual Property.
    2. You will not use or permit the use of any Intellectual Property except for the purposes contemplated by the Service.
    3. You may view and use the Content for personal and non-commercial purposes only. The Content may not be reproduced, distributed, transmitted, published, displayed, broadcast, stored, adapted, licensed, altered, hyperlinked or otherwise used in any manner or by any means without our prior written consent.
  12. Liability
    1. The Services are provided on an "as is" and "as available" basis and you agree and accept that you use the Services or access any Content obtained through the Services at your sole risk. We and our Service Providers expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you from us or through the Services will create any warranty not expressly made in this Agreement.
    2. If you are dissatisfied with the Services or with any of the terms and conditions of this Agreement, your sole and exclusive remedy is to discontinue accessing and using the Services or terminate the Services according to this Agreement.
  13. Indemnity
    1. You agree to indemnify us and our Service Providers in full against all damages, losses, costs, charges, expenses, liabilities, claims, demands, proceedings and actions sustained or incurred or established against us or our Service Providers and which in any case arises out of, in relation to or by reason of your use of the Services, your negligence or breach of this Agreement.
  14. Changes to this Agreement
    1. StarHub may change this Agreement and will post the modified Agreement at our website at Legal Notices & Terms. If you do not agree to the modified Agreement, you should stop using the Services. Your continued use of the Services after the date the modified Agreement is posted will constitute your acceptance of the modified Agreement.
  15. Additional - Connecting Tones Services
    1. The Connecting Tones Service is part of the Music Anywhere Services. Connecting tones services are only available to existing StarHub mobile post-paid and pre-paid customers, and are not available to multi-SIM customers.
