Terms & Conditions - TV Apps Service

  1. General
    1. The use of the Service (as defined in Clause 2.1.3 below) is subject to:
      1. StarHub's Consumer General Terms & Conditions;
      2. the Service Specific Terms and Conditions for StarHub TV Services; and
      3. any other terms and conditions that you and we may have agreed to from time to time.

  2. Definitions
    1. In these Service Specific Terms and Conditions:-
      1. "Content" means all information, text, sound, music, Software, photographs, videos, graphics, data, messages or other materials.
      2. "Network" means all networks owned, maintained or operated by, and/or leased/licensed to us including our nation-wide broadband network whether operated over a hybrid co-axial and fibre optic or a fibre-to-the-home platform, through which we provide the Service to you.
      3. "Service" refers to the service provided by StarHub Cable Vision Ltd. (Reg. No. 199103398C) by which you can access various applications (including our applications and those of third parties) (“Apps”) via our set-top box, and through the Apps, request for and obtain from us or third parties, certain information, products, social media accounts, Content or other services.
         
  3. Eligibility
    The Service will be provided only if you are a Subscriber to the StarHub TV services and have a set-top box duly issued and authorized by us.

  4. Responsibility for Service
    1. You are responsible for the use of the Service under your account(s) and for any App, information, product, social media account, Content or other service accessed, procured, displayed or published through the Service. You will be liable for all charges, fees, transaction charge or other costs which are incurred through the use of the Service under your account or imposed by us whether or not such App, information, products, social media accounts, Content or services were actually procured or used by you.
    2. You will promptly pay for all charges, fees, transaction charges or other costs which are incurred under your account through the use of the Service.
    3. The Service is provided to you solely for your private use and unless otherwise permitted by us in writing, for use in residential properties only. You will not exhibit in public or collect any fees for the use of the Service. Unless otherwise permitted by us in writing any use of the Service for commercial or business purpose or any other non-residential use, whether by you or other person under your account is a breach of your terms of use of the Service.
    4. You must not use or allow any part of the Service, or the Apps, information, products, social media accounts, Content or services provided through the Service, to be used to be resold or otherwise provided to third parties without our prior written consent, whether for profit or not.
    5. The use of the Service is subject to any instructions, notices, and directions as may be determined by us from time to time.
       
  5. Procurement of third party Apps, information, products, social media accounts, Content or services through the Service
    1. We may, through the Service, enable you to procure certain Apps, information, products, social media accounts, Content or other services which are provided on an “as is” and “as available basis”. Such transactions are carried out strictly between you and the relevant third party provider of such App, information, products, social media accounts, Content or other services, and we are not a party to such transaction. We are not responsible for or liable to you in any way or for any loss, damages, costs, expense or other liability suffered by you, any viewers or other party arising from the transaction.
    2. We may, through the Service, enable you to access, use and display the social media accounts of yourself or any third parties, which are provided to you on an “as is” and “as available basis”. Such access, use, display and all activities that you or any third party undertake with regards to the social media accounts through the Service are carried out strictly between you and the relevant third party provider of such social media services and we are not a party thereto. We are not responsible for or liable to you or any third party for any access, use and display of social media accounts through the Service, including but not limited to any publication, communication, exhibition or distribution of any of the Content contained in the social media accounts. You will indemnify us, our Affiliates, employees, directors and agents in full against all claims, damages, losses, liabilities, costs, expenses, demands and actions resulting from all use of the social media accounts through the Service and for all Content contained therein.
    3. You may, through the Service, obtain or rely on certain Apps, information, products or services which are of a financial nature and supplied by third parties. We are not the provider of such Apps, information, products or services and do not represent or warrant the accuracy, correctness, completeness or timeliness of such Apps, information, products or services.
    4. None of the Apps, information, products, social media accounts, Content or other services that you can procure through the Service constitutes a recommendation, an offer to sell or a solicitation of an offer to purchase any investment, or provide any investment advice or service. Independent advice should be sought before making any investment decision using the Apps, information, products, social media accounts, Content or other services that you can obtain through the Service.
       
  6. Customer Service Queries
    1. You will refer any queries, faults, defects or issues that you may have in respect of the Apps, information, products, social media accounts, Content or other services that you access or procure through the Service to the relevant third party provider of such Apps, information, products, social media accounts, Content or other services, and not to us.
    2. You may call our Customer Service hotline at 1633 only in relation to the Service. Our Customer Service personnel will have no obligation to provide service or support in relation to the Apps, information, products, social media accounts, Content or other services that are accessed or procured through the Service.
       
  7. Change in the Apps, information, products, services or Content provided on the Service
    1. We may at any time, change, withdraw, suspend or terminate, without prior notice to you, any of the Apps, information, products, social media accounts, Content or services which are provided on the Service.
    2. You acknowledge and accept that certain applications are not supported by the Service.
       
  8. System Requirement
    1. Your are responsible for ensuring your equipment and systems connected to the Network meet the Service’s minimum system requirements as may be stipulated by us, and that they are compatible and may properly function and inter-operate with the Service and the Network. We will not be liable for any loss, costs, damage, expense, lost opportunities, failed transactions, Service or Network failure or performance degradation resulting from the non-compliance of such requirements as set by us from time to time.
       
  9. Liability
    1. The Service is provided on an “as is” and “as available” basis and you agree and accept that you use the Service or rely on or use any Apps, information, products, social media account, Content or services from or through the Service at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, and fitness for a particular purpose and non-infringement to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you through the Service will create any warranty not expressly made in this Agreement.
    2. If you are dissatisfied with Service or with any of the Terms & Conditions of this Agreement, your sole and exclusive remedy is to discontinue accessing and using the Service or terminate the Service according to this Agreement.
    3. We assume no liability or responsibility for the acts or defaults of the third party providers of Apps, information, products, social media accounts, Content or other services that you can obtain through the Service or for any non-delivery, non-performance, defects, failures, errors or inaccuracy in any such Apps, information, products, social media accounts, Content or other services. We shall not be liable in anyway whether to you, or to any other viewer, person or entity for any loss or damage (whether direct, indirect, incidental, consequential, special, punitive or exemplary damages including lost profits, revenue, business or anticipated savings) arising as a result of the Service or from any Apps, information, products, social media accounts, Content or services accessed or procured through the Service or any decision, reliance or action based on the Apps, information, products, social media accounts, Content or services accessed or procured through the Service.
       
  10. Proprietary Rights
    1. All Apps, information, products, social media accounts, Content or other services presented to you through the Service by the providers thereof, us, the advertisers, or other third parties are protected by copyrights, trademark, service marks, patents or other proprietary rights and law. You agree that you are only permitted to use such Apps, information, products, social media accounts, Content or other services as expressly authorized by the providers, ourselves, the advertisers or the third parties in question, as applicable.
    2. You are not permitted to copy, reproduce, distribute, or create derivative works from any Apps, information, products, social media accounts, Content or other services accessed procured through the Service without written authorization from us, the advertiser, the provider or third party in question.
       
  11. Others
    1. We may, at any time and without any notice to you, temporarily suspend the Service or any part thereof for operational reasons such as repair, maintenance, upgrade or improvement of the Service or because of an emergency. We will restore the Service as soon as reasonably practicable. We may also modify the Service in order to keep pace with the prevailing demands and technological developments, at our discretion wand without any notice to you.
    2. We reserve the right to revise any of these Terms & Conditions at our discretion without prior notice. Continued use of the Service will constitute acceptance of these Terms & Conditions (including any revision thereof).
