Terms & Conditions - Interactive TV Services

 

  1. Definitions
    1. In this Section:
      1. "Content" means all information, text, sound, music, Software, photographs, videos, graphics, data, messages or other materials.
      2. "Network" means all networks owned, maintained or operated by, and/or leased/licensed to us) including our nation-wide broadband network whether operated over a hybrid co-axial and fibre optic or a fibre-to-the-home platform, through which we provide the Services to you.
      3. "Service" refers to the Interactive TV Services provided by StarHub Cable Vision Ltd. (Reg. No. 199103398C) through which you can request for and obtain from third parties, certain information, products, services or Content.
  2. Eligibility
    1. The Service will be provided only if you are a Subscriber to the StarHub Cable TV services and have a HubStation or such other personal recording device duly issued and authorized by us.
  3. Responsibility for Services
    1. You are responsible for the use of the Service under your account(s) and for any information, product, service or Content procured through the Service. You will be liable for all charges, fees, transaction charge or other costs which are incurred through the use of the Services under your account or imposed by us whether or not such information, products, services or Content were actually procured by you.
    2. You will promptly pay for all charges, fees, transaction charges or other costs which are incurred under your account through the use of the Services.
    3. The Service is provided to you solely for your private use and unless otherwise permitted by us in writing, for use in residential properties only. You will not exhibit in public or collect any fees for the use of the Services. Unless otherwise permitted by us in writing any use of the Service for commercial or business purpose or any other non-residential use, whether by you or other person under your account is a breach of your terms of use of the Service.
    4. You must not use or allow any part of the Service, or the information, products, services or Content provided thereunder, to be used to be resold or otherwise provided to third parties without our prior written consent, whether for profit or not.
    5. The use of the Services is subject to any instructions, notices, and directions as may be determined by us from time to time.
  4. Procurement of third party information, products, services or Content through the Services
    1. We may enable you to procure certain information, products, services or Content which are provided on an “as is” and “as available basis” through the Service. Such transactions are carried out strictly between you and the relevant third party provider of such information, products, services or Content, and we are not a party to such transaction. We are not responsible for or liable to you in any way or for any loss, damages, costs, expense or other liability suffered by you, any viewers or other party arising from the transaction.
    2. You may, through the Service obtain or rely on certain information whether financial or otherwise, which are supplied by third parties. We are not the provider of such information and do not represent or warrant the accuracy, correctness, completeness or timeliness of such information.
    3. None of the information, products, services or Content that you can procure through the Service constitutes a recommendation, an offer to sell or a solicitation of an offer to purchase any investment, or provide any investment advice or service. Independent advice should be sought before making any investment decision using the information, products, services or Content that you can obtain through the Service.
  5. Customer Service Queries
    1. You will refer any queries, faults, defects or issues that you may have in respect of the information, products, services or Content that you procure through the Service from such third party supplier, and not to us.
    2. You may call our Customer Service hotline at 1633 only in relation to the StarHub Cable TV service. Our Customer Service personnel will have no obligation to provide service or support in relation to the information, products, services or Content that are procured through the Service.
  6. Change in the information, products, services or Content provided on the Service
    1. We may at any time, change, withdraw, suspend or terminate, without prior notice to you, any of the information, products, services or Content which are provided on the Service.
  7. System Requirement
    1. Your are responsible for ensuring your equipment and systems (including the personal recording devices) connected to the Network meet the Service’s minimum system requirements as may be stipulated by us, and that they are compatible and may properly function and inter-operate with the Equipment, the Service and the Network. We will not be liable for any loss, costs, damage, expense, lost opportunities, failed transactions, Equipment, Service or Network failure or performance degradation resulting from the non-compliance of such requirements as set by us from time to time. You acknowledge and accept that certain applications are not supported by the Service.
  8. Liability
    1. The Service is provided on an “as is” and “as available” basis and you agree and accept that you use the Service or rely on or use any information, products, services or Content from the Service at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you through the Service will create any warranty not expressly made in this Agreement.
    2. If you are dissatisfied with Service or with the information, products or services made available on or through the Service or with any of the Terms & Conditions of this Agreement, your sole and exclusive remedy is to discontinue accessing and using the Service or terminate the Service according to this Agreement.
    3. We assume no liability or responsibility for the acts or defaults of the third party suppliers of information, products, services or Content that you can obtain through the Service or for any non-delivery, non-performance, defects, failures, errors or inaccuracy in any such information, products, services or Content. We shall not be liable in anyway whether to you, or to any other viewer, person or entity for any loss or damage (whether direct, indirect, incidental, consequential, special, punitive or exemplary damages including lost profits, revenue, business or anticipated savings) arising as a result of the Service or from any information, products, services or Content procured through the Service or any decision, reliance or action based on information, products, services or Content procured through the Service.
  9. Proprietary Rights
    1. All information, products, services or Content presented to you through the Service by us, the suppliers of such information, products, services or Content, our advertisers, or other third parties are protected by copyrights, trademark, service marks, patents or other proprietary rights and law. You agree that you are only permitted to use such information, products, services or Content as expressly authorized by us, the advertiser or the third party provider in question.
    2. You are not permitted to copy, reproduce, distribute, or create derivative works from any information, products, services or Content procured through the Service without written authorization from us, the advertiser, the provider or third party in question.
  10. Others
    1. We may, at any time and without any notice to you, temporarily suspend the Service for operational reasons such as repair, maintenance, upgrade or improvement of the Service or because of an emergency. We will restore the service as soon as reasonably practicable. We may also modify the Service in order to keep pace with the prevailing demands and technologic developments, at our discretion wand without any notice to you.
    2. In addition, your use of the Service is subject to the TV Service Specific Terms & Conditions.
    3. We reserve the right to revise any of these Terms & Conditions at our discretion without prior notice. Continued use of the Services will constitute acceptance of these Terms & Conditions (including revision thereof).
